MK Inc. Thinks Touch of Pink is Bad? This MK Reseller is Stealing All of Their Copyrighted Pictures!

I’ve been trying to get the word out to resellers of Mary Kay that MK Inc. is filing hundreds of lawsuits against liquidators.

In doing so, I stumbled across this Mary Kay reseller who is advertising on eBay:

They have a fancy store that’s much more professional looking than Touch of Pink.

And ALL the photos in their store appear to be Mary Kay Inc.’s copyrighted photos! It looks like they’re stealing them off the Mary Kay website!

Not only that, but ALL the descriptions of the products are copied verbatim from Mary Kay’s website!

Here’s someone who is REALLY violating Mary Kay’s trademark and copyright. Wonder if they’ve gotten slapped with a lawsuit yet?

    Oh I have one to add. Go to http://www.ebay.com and put in auction #120344407509. This lady has her mary kay website!!! Maybe if Mary Kay spent it’s time searching instead of filing lawsuits they may have more control.

    Helloooo MKC…clean up your own house before you go after somebody else!  Ridiculous, if they wanted to find consultants violating their IBC agreements, this one would be easy to find!

    It seems they’re not aafter active consultants who are buying product from MKC and selling however they can, they just want to stop anyone else from selling however they can if they aren’t still feeding the “pink pig”.
    Where are lisa and Be Authentic when you need them?

    I went on ebay after I read the post and in 5 minutes flat found 4 more just like her. I’m just a little stay at home Mom and I found it. My thought if Mary Kay is so good at training their consultants how come these 5 don’t know they can’t list on ebay???  I didn’t put the other 4 because Mary Kay can do their own research.

    Lipstick – here I am !!!!!!

    I decided that in my pursuit to right the wrongs of those who do things they are not supposed to do that I would put down my showcases Lipstick and call a truce.  I did not come on this site to tell you how to live your life or run your business (whatever it is that you do now).
    Yes, you are right, I am very passionate about what I do and because of that I have two new team members as of today.
    I guess because I do everything I am supposed to do, I think everyone else should.  I guess because I would never quit MK, I don’t think anyone else should.   That’s the perfect pink bubble that I live in.

    And just so all of you know, I have people in my circle of influence who don’t always support what I am doing but that is their issue to deal with.  All I can say is that when the Pink Trophy on Wheels show up, I’ll be charging them to take a ride.

    Be Authentic, I wasn’t trying to argue with you!  I once lived in the pink bubble too, as a matter of fact I quit a full-time job with benefits so I could be in the pink bubble all the time.

    But like the old saying, “The grass isn’t always greener on the other side”, I soon found out that when you reside in the pink bubble all the time, things aren’t quite as rosy as they seemed when you only visited for periods of time.

    My dear husband said something a couple of days ago, that I believe fits here and a lot of other places:  “You can’t legislate morality”.

    That’s true whether you live in or out of the pink bubble… there will always be people who don’t do things right and they really don’t care.  Some people will be honest only when others are looking. some people will be honest all the time and some people will do as they please and they don’t care what others think.

    Good luck to you Be Authentic…but should you ever decide that MK isn’t all you thought it was, come on back and you’ll find a great bunch of ladies who will help and support you.

    The best thing about this site is that when you do come back nobody will say “I told you so!”
    Instead you’ll get a warm welcome with lots of support and words of encouragement that will let you know you aren’t alone!

    I have to say that they don’t really broadcast very loudly that you aren’t supposed to sell your products via places like eBay, or at least the lady who I signed on with didn’t speak of it.  AFTER I had already listed a few times I found the documentation (while looking up tax information) that I had allegedly signed stating I would not sell through auction sites.  Oops.  I personally think that’s one of the lamest rules they have, why do they care how I sell the product so long as I am buying/selling it??  I know they try to say they can’t control the quality that way but eBay has a built in way of weeding out the bad people who sell old stuff.  A few negative feedbacks and nobody will be buying from them anymore unless the product is so cheap they don’t care.  ;-)

    Megan, IMO the reason they don’t talk about it is that if people realized how little control they have of “their own business”, they would never join MK.

    MKC controls every aspect of every avenue for making money.  Web site, advertising?  You can only use MK’s web site (for a fee) and no advertising except what they have already approved and designed.

    Samples, business supplies, display cases, inventory cases, business cards, post cards, checks…it’s all available through MK, and they are the ones making the profits!

    Even SD’s and NSD’s are limited to ideas, tapes and books they want to market.  It’s done the MK way or no way at all.

    here i am, as well!  i used to go on e-bay and write down all the gals and their info that were selling mary kay, including the ones that listed their mary kay websites, and send them to corporate!  that only lasted about a month or two, then i realized that was wasting my time and energy – everyone answers sooner or later for their actions, good or bad, right or wrong.  i do hope the ladies that are showing their mary kay websites are “informed” from the company and given a second chance – they may have not read their agreement.  if they’ve already been “informed” and chose to ignore it, then i say let the chips fall where they may.  my oldest daughter, the other day, said the exact same words as lipstick’s hubbie ( “you can’t legislate morality”) in our continued discussion of abortion.  hours later we were coming back from a movie and something happened (i don’t remember now what) that she went on a rant “ …people that do that (again, whatever it was) should be…” (whatever it was she said), to which i replied, “you can’t legislate morality.”  the car was quiet!  have a great new week, ladies!

    I think that if you purchase a product you may resell the product however moral way possible.  OF COURSE using small foreign children to peddle the product door to door would be immoral, which ebay auctions or touch of pink are innocent of this immoral behavior.  you buy a product and resell it no one can ban your freedom.  !!  Seek a civil liberty union attorney for more freedom rights ladies!!  STAY PINK HOWEVER WAY YOU CHOOSE!!

    The only place Mary Kay Inc can file for trademark infringement is federal court, and the only place they can file against a business outside Texas is in a federal court. I just finished searching electronic court records for the Federal Courts for any filings where Mary Kay Inc is the plaintiff, and I am not seeing “hundreds of lawsuits”. I only found the two I already know about, Lilley and Touch of Pink.

    It is possible that there have been hundreds of DMCA actions by Mary Kay corporation – especially against eBay sellers who don’t take their own pictures. It is possible that there have been hundreds of sternly worded threats of legal action and demands for settlement with a threat of a lawsuit in the letter … but it is extremely difficult to have hundreds of lawsuits filed against hundreds of liquidators and leave no trace in the court system.

    I am going to search the Texas filings next, but I think you have been mis-informed about the content of the letters.

      No, these are not copyright infringements against sellers for pictures on eBay.

      Several liquidators were threatened with lawsuits unless they revealed all the information about their business and their customers. If they don’t, they are being threatened with lawsuit. So yes, I suppose the way I worded it might have been a little extreme. However, one of the people who received such a letter has now been formally served by Mary Kay.

      I haven’t been misinformed.

      But I am curious as to why you suddenly show up and start digging at this. If you’re trying to challenge my accuracy…good luck.

      I don’t know why I detect a tone of irritation in your comments.

      You emailed me privately several times asking for the personal information about the people who have contacted me. Don’t you think if they wanted to be named I would name them?! Do you really think that I would be slimy as to print people’s names with disregard for their privacy? Maybe you would, because they’re are certainly site owners out there who behave in such a callous and childish way.

      But if you spent any decent amount of time here, you’d know I don’t work that way. Sorry.

    I was once too a mary kay consultant.  My director PROMISED AND PROMISED me to help sell what I went in debt for her. I did the 3600 so she could get her new saturn vue Guess what?!!? I have over half of it still here! I did the activities that she told me to, I talked to 3 new people a day 3 months in a row and product was moving, slowly.  She continued to build her team, got the vue, and stopped answering my phone calls, emails and would avoid me when I would stop in to ask her a question.  I told her I was going to send it back. She promised to have a check to me for the remainder of what I had and she would get it from me… That was in December. My contract was up the 31 as of the 1st I was unable to send anything back to corporate because when I ordered she DID NOT tell me that the product would be discontinued within a short time.  (she knew she had the new look book that her director gave her to look at the new product) So here I sit with 1500-2000 dollars worth of product to sell and technically I can not hold a class and sell it because I am no longer a consultant.  I would have to re-sign up and sell what I have (if it has not expired).  Mary kay talks about being a DEBT FREE business yes, I would say that is right, they have a mark up on their product have a potential to make a lot of money.  Right now I am just looking to get what I owe out of the product and call it quits.
