Another Liquidator Sued by Mary Kay Inc.

I just received an email from yet another Mary Kay inventory liquidator that they were served with a lawsuit on Monday. This person has been selling on eBay and her own online store since 2000.

It’s apparent that Mary Kay Inc. is going after anyone who is selling Mary Kay products on eBay and in an online store.

If you sell Mary Kay products on eBay or online, beware! Mary Kay Inc. is on a mission to get rid of you.

    When an individual signs their independent beauty consultant agreement, they are well aware that selling MK on an online auction site is a violation of that agreement and you can and will be terminated.  What part of “you can’t do this” don’t you ladies understand?  It’s not hidden anywhere so you can’t say you didn’t see it.
    I am so grateful that Corporate is taking on people who are doing things they are not supposed to be doing.  I run my business strictly by the book and I make “no exceptions” – this is why my business works.
    If you don’t work your business, then you don’t make any money.  If you buy a big inventory and don’t work your business, you will still have a big inventory.  You just can’t sell it on E-Bay or Touch of Pink, or I’m Too Lazy to Make an Appt..com, whatever.
    Bottom Line:  If you cannot do this business the right way . . . . . then you get what you deserve.

    Be Authentic…no need to be nasty!  The liquidators selling these products are not current consultants and haven’t been for years.  Most of the people selling their inventory to a Liquidator have already terminated their agreements and sent what product they were eligible to return to MK for 90% buyback.

    Bottom line, is they bought the product fair and square from MK and are no longer affiliated with the company.  Therefore they should be able to sell whatever they want to whomever they want.

    Do you think Liz Claiborne sues people who sell their old clothing at a yard sale or to a consignment shop?  NO…same thing with MK, only MK is not exactly designer makeup!

    The only person being “foul” is MK and they also deserve what they get!

    Be Authentic, why did you feel the need to come here and how did you find this website? I’m not trying to be rude, I just notice that you are very passionate about your business, so why are you here when you obviously know that this is an anti MK/MLM web board.
    Like you said we will never see eye to eye, but I implore you to read more of the stories from ex-consultants, or feel free to share your MK story.
    You don’t have to agree, but to have an understanding and to respect where most people here are coming from is freeing.
    Many here understand where you are coming from and believe me, we try very hard to respect that…but please understand that that can be hard when we reflect upon our own experiences.

    Have you ever though that these liquidators might not have ever been a Consultant and never signed any agreement? Plus, from the legal side of this…after a contract is terminated, it’s just that….TERMINATED! A former consultant does not have to agree to those guidelines anymore.

    Most all of the inventory liquidators have NEVER been in Mary Kay. They just saw a REAL business opportunity in buying and reselling this excess inventory that consultants get pressured into buying.

    “Be Authentic” found us because she was searching the term “Robin Blackmon-Dunda.”

    You know…the Mary Kay Director who sued Mary Kay Inc.?    😉

    I for one am VERY glad there were people already selling on ebay that would buy my leftovers.  MK changes their product line so many times and run “challenges” knowing that the product is about to be discontinued, it makes it difficult for someone no “in the know” get ahead.

    Because of the liquidators, I was able to get rid of all my nightmares.

    To MK for sueing the liquidators;  make you crash and burn.

    just curious – lj – how did you know what be authentic was searching for?  and fyi – the gal that does touch of pink was a former consultant.

      Lisa…server stats tell me lots about the traffic here.

      And yes, Amy Weber, the owner of Touch of Pink Cosmetics, is a former Mary Kay consultant. That’s been presented in posts and the court documents.

    I don’t know how they even have a leg to stand on. As a previous poster stated, even IF you ever WERE a consultant if you terminate or MK terminates your contract then what business is it of THEIR’s as to what you do with the thousands of dollars MK won’t take back. I can pick an MK consultant or better yet, a Director out on ebay in a minute compared to those who are buying on ebay and reselling. Many of those sellers are consignment shops BTW, not MK consulatnts at all. I heard that some sellers are getting served with depositions asking the ebay sellers to divulge WHO sold them the MK on ebay… names, adresses, phone numbers.. HUH??? Who does Mk think it is??? And I couldn’t agree MORE with the person who made the comment about Liz Claiborne suing.. I made the SAME comment except I used Polo Ralph Lauren and I said, so If I go and I buy a pair of Polo jeans on sale and I either grow out of them or don’t want them anymore, I’m breaching COPYRIGHT laws when i list them as RALPH LAUREN POLO JEANS???? What makes the Mary Kay NAME any different than any other brand besides the fact that they hoodwink women into their congame…. Has anyone EVER seen the actual SALES to customers from MK???? with 22K listings on ebay right now and MANY of them LOTS, I’d say that A LOT of their “figures” are BS… and JUST what they con their consulatnts into buying…
