Touch of Pink Cosmetics and Mary Kay Inc Agree to Mediation

Mary Kay Inc and Touch of Pink Cosmetics have agreed to enter into mediation to settle their dispute.

The original court date set for this fall has been moved back to February 2009.

  1. I feel that TOP is doing nothing wrong. I mean, how many people sell old stuff for cheap (stuff they didn’t make themselves) on Ebay? try everyone. If they can, why can’t TOP? So…I hope they come out ahead in this. MKC needs to know they can’t make special rules for people who aren’t in their employ.

  2. Unless MK can prove that TOP solicited sales from current IBC’s, SD’s, NSD’s and I don’t see how they can, I don’t think they can hold TOP responsible and claim any damages. 

    TOP does not have the ability to check status of a person wanting to sell their invenotry for liquidation and they do state on their web site that they are not affiliated with MK and that they buy inventory from FORMER MK IBC’s.  A person can certainly represent themsleves as a former IBC and TOP has no way to verify that info nor should they be responsible for verifying it.

    After the contract is terminated either by MK or the IBC they are free to sell to whomever they want for any price they choose.

    I hope TOP comes out the winner and I am waiting for the time that an IBC sues MKCorp for
    the actions of some of the recruitiers in projecting false claims of income in the MK “opportunity”….I will be cheering that law suit on!!!

Thanks for posting this.  I had been wondering what was going on.  I hope TOP comes out on top.  They did nothing wrong at all.  I mean would Mary Kay Inc. rather get back all of that inventory and lose money or maintain and let someone else take it off of their hands?  I agree with both comments above.  They are just being greedy.  My favorite saying is, “What Goes Around, Comes Around.”  I am cheering for TOP all the way!
